General Terms and Conditions of Sale
Article 1: Scope of application
These General Terms and Conditions of Sale are concluded between the ancestral publisher of the site www.ancestral.be, whose head office is located at rue des iguanodons 154 a 7320 Bernissart registered in the Trade Register under the number BE0637714523, and all physical or non-physical persons, referred to as "members" who have been invited to register on the private sales website www.Ancestral.be and wish to order one or more offers proposed by the site. These General Terms and Conditions of Sale apply to all orders placed through the website www.ancestral.be, named ancestral in these general terms and conditions of sale. In the absence of any particular stipulation in these conditions and agreed in writing between the parties, orders are automatically subject to these general terms and conditions of sale, regardless of any clauses that may appear on the buyer's documents. Unless expressly and in writing accepted by ancestral, no particular condition can prevail against these General Terms and Conditions of Sale. By validating the order, the member acknowledges having read these General Terms and Conditions of Sale and accepts their terms.
Article 2: Prices
The prices indicated are expressed in euros and are all taxes included. They notably include VAT applicable at the various common law rates, excise duties and all other applicable taxes. The prices displayed are net and excluding participation in shipping and delivery costs. The member's participation in shipping costs is flat-rate. They can be modified at each sale. Ancestral reserves the right to modify its prices at any time, however the products will be invoiced on the basis of the rates displayed on the site and in force at the time of registration of orders.
Article 3: Order
Ancestral undertakes to accept orders under the terms of these General Terms and Conditions of Sale and within the limits of available stocks. Ancestral will honor each order by delivering the ordered products according to the availability of the products at the time of the order. Any order will only be taken into consideration after acceptance of payment by our banking organization. Your basket cannot contain more than 120 bottles. The maximum quantity may vary depending on the delivery conditions imposed by our delivery providers as part of the COVID procedures. Ancestral reserves the right to cancel all non-compliant or dubious orders, as well as those of a member with whom there is a dispute relating to the payment of a previous order. By validating the order, the member declares to have read and accept these General Terms and Conditions of Sale. The validation of the order therefore implies acceptance of these General Terms and Conditions of Sale.
Article 4: Preparation of the order
The order is prepared when Ancestral has received all the elements necessary for the proper execution of the contract (delivery address in particular). If all or part of the delivery address turns out to be incorrect, forcing ancestral to return the orders to its warehouse, the member will be charged for the additional shipping costs as well as a compensation of 10 euros corresponding to the logistics costs.
Article 5: Availability and validity of sales
The offer of products is valid within the limit of the duration of each sale and within the limit of available stocks. If stocks were to become unavailable after registration of the order, ancestral will inform the member and propose the refund of the order via bank transfer.
The course of a sale
Access via the site www.ancestral.be
Log on to www.ancestral.be during the sale period. You access the homepage of the site where you enter your email address and your password. If you have forgotten your password, click on "forgotten password", enter your email address. Ancestral will send you a new password automatically generated by email.
The sale
On the home page, find the current sales, indicate for each chosen product the quantity you wish to order. Shipping costs are added to the amount of your order, when choosing the delivery method. A confirmation of the delivery address will be requested. Your order is only validated when you have proceeded to its payment by credit card, or Paypal according to the payment method chosen at the time of purchase. You will receive an email confirming your order, with the details of it, the amount paid and the delivery address.
Article 6: Delivery
Realization of the delivery
Deliveries are made exclusively Belgium, The bottles travel in cardboard boxes adapted for transport. Shipments are made from a dedicated logistics site and taken care of by the provider in charge of delivery. The order is delivered to the delivery address specified by the member when validating his order. An online order tracking is available in the section "My account - History and details of your orders". The package is presented at the recipient's address. It will then be handed over either to the recipient, or to any other person present at the designated address.
Important information: when receiving your order, it is imperative to open the boxes in front of the delivery person or the representative of the relay point and to check the accuracy of the delivery compared to the order. Any anomaly or deterioration must be mentioned on the slip, in a clear, precise and detailed manner (the mention "subject to unpacking" is not valid in case of claim). You must inform ancestral the same day so that the procedure for opening a dispute with the carrier is put in place. Ancestral cannot be held responsible in case of non-compliance with the above provisions.
Shipping time
The shipping time is set at 30 days maximum after the registration of the order (except for the end of year holidays where your order is shipped within a shorter period). Unless otherwise stipulated, the products are shipped within the times indicated above, when the order is placed. In case of exceeding the deadline, the customer can cancel his order under the conditions provided in Article 10 of these General Terms and Conditions of Sale. Delivery times are average times corresponding to the time of processing the order and delivery. These times vary according to the destination and do not include public holidays or weekends. Each delivery is deemed to be made as soon as the product is made available to the recipient by the carrier, as evidenced by the carrier's control system. It is up to the recipient to check the delivery on arrival and to notify the carrier of any claim that appears justified, or even to refuse the package, if it is likely to have been opened or if it shows clear signs of deterioration.
Delivery error
If the products delivered are not in accordance with the order or the specifications indicated on the delivery note, the member can cancel this order within fourteen days following the delivery. Simply go to the "Contact" section on www.ancestral.be, and send us a cancellation email of the order including the reference of it, as well as for any case of delay, breakage or missing element. See Article 10 for the order cancellation procedure.
Lost package
When a package leaves the warehouses of our logistics provider, it is transported by the carrier designated by ancestral. It then takes 3 to 5 working days to be delivered or to receive an email or sms to schedule the desired delivery day. If 7 working days after the shipment of the package, the member has no news of his order, he must contact the Member Relations Service through the "contact" section, on www.ancestral.be The Member Relations Service of ancestral will open an investigation with the services of the carrier. The member will be informed by email of the follow-up given: if the package is found, the delivery procedure resumes its normal course and it is delivered to the recipient; if the package is declared lost, ancestral informs the member and immediately initiates a replacement or refund of the package (products and shipping costs) by voucher via the online store.
Article 7 – Withdrawal
a) Case of withdrawal
The member has a period of fourteen clear days from the delivery of his order to return the delivered Article for refund, without penalties. The member will then have to cancel the order in the "Contact" section on the site www.ancestral.be and return the goods to the indicated address. The return costs are at the member's expense. The value of the concerned order will be refunded within a maximum period of 14 days (fourteen days) from the date on which the cancellation request was made. The cancellation can be made before the shipment by request by email. In this case, a refund is made within 14 days (fourteen days) from the cancellation request. If the right of withdrawal is exercised before delivery but after receipt of the shipping email, the return costs will remain at the member's expense. If the right of withdrawal is exercised after the sending of the shipping email, the refund will be deferred until recovery of all the products by ancestral, or until the member has provided proof of the shipment of all the products. Ancestral will make the refund using the same means of payment as the one used by the member for the initial transaction, unless express agreement of the member for it to use another means of payment and insofar as the refund does not incur any costs for the member. Ancestral is not required to refund additional costs if the member has expressly chosen a more expensive delivery method than the standard delivery method offered on the site www.ancestral.be on the day of the order.
b) Conditions of application
This right of withdrawal can never apply if the delivered products have obviously been used (consumption of the delivered product, opening of the delivered product, use of the delivered product). The products must imperatively be returned properly protected, in their original packaging, in a perfect state of resale (not damaged, damaged or soiled by the member) accompanied by all possible accessories, instructions for use and documentation to the address of Ancestral chemin de wiers 63 a 7600 Péruwelz. The costs and risks related to the return of the product are at the expense of the sender/member. The return of the products will result in a refund equal to the purchase price of the product(s) purchased. The refund therefore does not include any possible delivery costs. As soon as the return is processed, ancestral sends a first email informing of the receipt of the package. The refund is made by the same means of payment as for the initial transaction or by voucher unless the amount of the returned products is higher than the amount actually paid online in the case of the use of vouchers. In this case, the member will be credited with the sum actually debited from his account when ordering, vouchers deducted. No return shipment against refund will be accepted, whatever the reason.
Article 8: Participation in shipping costs
Shipping costs consist of a contribution to the costs of preparing and packaging the order and postage costs. They are flat-rate and can be modified at each sale.
Article 9: Payment and security
The payment of the goods is made either by credit card, or by PayPal. The member is debited the amount of his order as soon as the payment is registered. By validating his order on the website www.ancestral.be, the member is put in direct relation with our banking organization. The transmission of credit card numbers is totally secure (SSL encryption). Ancestral never has access to confidential information related to the means of payment. The member's bank details will be requested for each new order. The member guarantees that he is fully authorized to use the credit card he uses and that this credit card gives access to sufficient funds to cover the costs of the order.
Article 10: Delivery error of the order
If the products delivered are not in accordance with the order or the specifications indicated on the registered order, the member can request the refund of the order. To do this, he must proceed to the cancellation of the order in the "Contact" section and return the package within seven days following the delivery, provided that he has previously issued reservations on the delivery note of the carrier or the relay point package. The refund by voucher will take place within 30 days from the receipt of the non-compliant products. In this case, the return costs will be borne by ancestral. The proof of shipping costs must obligatorily be attached to the package; in case of absence, no refund can be claimed by the member. The guarantee will not cover products damaged during misuse. Article 11: Reservation of ownership
The products delivered to the customer are sold under reservation of ownership. The transfer of ownership is subject to the total payment of the price of the products by the customer. In case of non-payment of the total price of the goods ancestral can claim the ownership of the products at the expense and risk of the customer.
Article 12: Intellectual property
All elements of the site www.ancestral.be (texts, photos, visuals and sounds) are the exclusive property of ancestral. Any person wishing to use personally elements of the site www.ancestral.be By visiting or ordering on the site www.ancestral.be, the internet user, member or not acquires no intellectual and industrial property rights on the editorial and graphic content of the site www.ancestral.be.
Article 13: Personal Data
In the context of registering on the site www.ancestral.be, the member must provide a certain amount of personal data about themselves. The mandatory data includes the last name, first name, postal address, email address, phone number, and date of birth.This data is necessary for order processing and, more generally, for managing ancestral's commercial relationships with its clients.
Ancestral is committed to securing and strictly keeping confidential the personal information provided by its clients.By accepting the General Terms and Conditions of Sale, the member acknowledges having read the personal data protection policy of the site www.ancestral.be.
Article 14:
Protection of MinorsThe sale of alcohol to minors under the age of eighteen (18) is prohibited.The client undertakes to be at least 18 years old when placing an order.Article 15: Buyer's AcceptanceThe present General Terms and Conditions of Sale, as well as the prices of the products sold on the site, are expressly accepted by the member, who declares and acknowledges having read them, and therefore the member waives the right to rely on any contradictory document, in particular, their own general terms of purchase.
The act of purchase entails the acceptance of the present General Terms and Conditions of Sale.Excessive alcohol consumption is harmful to health, and should be consumed in moderation.The consumption of alcoholic beverages during pregnancy, even in small quantities, can have serious consequences on the health of the child.
Selling or offering alcoholic beverages to minors under the age of eighteen is prohibited.
